Her book ‘Madam Prosecutor' is one of the sources used by the European Parliament Reporter Dick Martin at making of report over human body trafficking in Kosovo.
‘I publicly point out that I am ready to undertake this investigation because I am acquainted with the facts related to this case, because I know the people involved and because I have huge experience', Del Ponte said.
Q: Dick Marty who made the report is leaving politics at the moment when it is being decided if there shall be an independent investigation or not. Why?
‘I think the main reason is that he has been working as a rapporteur for a long time. Having in mind his age I suppose he would like to entrust the matter to younger people. It is also possible that as per the Swiss Law, after expiration of the mandate he cannot candidate himself for the same post. Still, these are only information from the newspaper which should be checked'.
Q: Do you think that he was under pressure to withdraw? Do you know that perhaps he was receiving threats because of the report?
‘As far as I know him he has never acted under pressure. I do not know about the threats but he has completed his job within mandate given to him'.
Q: What consequences shall his withdrawal have on the investigation, especially on witnesses who trusted Marty?
‘It is true that witnesses trust him completely but I think that independent investigation and independent team also might get their trust'.
Q: Did you help Marty in making of his report?
‘Marty and I met only once at his initiative and I told him everything we had done in the preliminary investigation. I also told him that he could find the proofs we collected at the Tribunal via the Chief Prosecutor's office. I have not participated in making of the report'.
Q: Now many are supporting independent investigation. In the meantime, however, the Tribunal has destroyed 400 peaces of evidence concerning this case collected in 2004. Why?
‘I was not aware about destruction of proofs. I even told Marty to go to The Hague and have a look at everything we had collected in the initial investigation. I learned about their destruction from newspaper last year and frankly I was surprised'.
Q: Has anything of those proofs left to be used in the forthcoming investigation?
‘Even the smallest part of those proofs can be important for the investigation. However the dossier in which everything has been collected, I am positive, still exists at the Tribunal and can be used'.
Q: Do you expect the initiative by Serbia at the UN SC for independent investigation over organ trade in Kosovo to be accepted? How important Ban Ki-Moon's support is?
‘I really hope that it shall be accepted. The Secretary General's support is very important'.
Q: Is it possible that some of big powers veto Serbian initiative?
‘I hope that shall not happen and I hope that this time unanimous decision over independent investigation could be made'.
