Ljimaj to be retried in Klecka case

The Supreme Court in Pristina has decided that Fatmir Limaj accused of war crimes, should be retried, while requests made by the prosecutor in the so-called 'Klecka case' should be granted only partially.

The chamber, composed of three EULEX and two local judges, rejected the prosecutor's request for Ljimaj and other defendants to be ordered detention.

The Supreme Court, however, decided that statements made by the now deceased Agim Zogaj, known as 'Witness X', whose testimonies the indictment was based on, should be considered during the retrial.

Zogaj committed suicide in Germany in September last year, but he left written and recorded evidence behind.

This spring, the District Court in Pristina acquitted Fatmir Limaj and nine other former members of the Kosovo Liberation Army of all charges after a trial of several months, since it decided earlier that statements made by the main witness, Zogaj, could not be used in the process against the defendants.

Five of the nine others defendants in the previous trial will also be retried. The prosecutor did not appeal the verdict concerning the remaining four persons.

The indictment charges Ljimaj and others them with murdering, torturing and endangering the health of Albanian and Serb civilians who were prisoners of war in a camp of the former KLA in the village of Klecka in the Malisevo municipality, central Kosovo.
